Default Anacortes

Hey,
This is my first post on this forum, but I hang out over at CN a bit and get up to Cherry Springs with a 20" RCX a few times a year. I joined here to give a heads up. When I googled Herb York, this forum came up the other day. The attachment here is self explanatory. It's Exhibit "A" to a Civil Complaint which is either just filed in Philadelphia as of this time or will be by early tomorrow. Once I get confirmation of the filing, I'll be happy to share it. Its .pdf format is twice the attachment limit for posting here, but anyone who wants a copy can e-mail me at kennyrichmond@comcast.net. You'll see the reasons for the legal proceedings in the attachment, but the complaint will be instructive for Anacortes and employees who seem to feel that a "long arm" can't reach them. I was persuaded to adopt a very unforgiving approach after reading the Herb York posts here, particularly the "you're toast" notice to one of the A-Mart participants. So read the e-mail exchange and take it under advisement.

Well Bud,

I'm afraid that the time for amicable resolution has passed. There are a lot of gentle,quiet amateurs out there who should reflect upon that attachment before authorizing a credit card payment to anything connected to Herb York.

Years ago I bought my NP101 from them and a lot of other stuff.......In the last few years all of my purchases have been from BT Technologies, Opt and Adirondack. I always get good value and service.

Thanks Loron,

They're in trouble and I would not want anyone else to send Anacortes a large deposit or a credit card authorization.

Of course I've notified Visa. If, after we get subpoena authority, we learn that Televue never had a delivery en-route, the matter gets far more serious.

Here is an update on the Anacortes matter. This morning's e-mail from Paula York was apologetic and indicated that a refund was being made to my account as of the 21st. No refund appeared in the account as of this time, and I have no tracking information. Then Herb York indicated it is in the hands of my credit card company, and that his order to TV was short. I sent him a "courtesy copy" of the law suit today. For the rest of you who requested copies, I have your e-mail and will get them to you as soon as I have the Court Docket number. Your requests (and applause) will be maintained in the strictest confidence. I do understand

Yes, I have been banned from Astromart, but in anticipation I have already downloaded my transaction ratings. Herb's response seems to threaten a report of the lawsuit to the Pennsylvania Legal Disciplinary Committee. This and the banning will play out well in a claim that entitles the victim to punitive damages (being heard, in the first instance, by three lawyers.) They should have overnighted a money order. I would have, but then maybe I'm not as smart as Herb.

Something similar to this must have been foreseen, they recently filed "LLC", clearly in anticipation!

Update:

Late Friday, EST, we received an e-mail on the stationary of the Anacortes gateway bank for credit card transactions formally confirming that a refund of $817.60 was in process and that it would take 72 hours from the 21st. for the refund to appear. Without further contact from Paula or Herb York, my earlier status with Astromart was reinstated. I accept these gestures as an empthathetic acknowledgment of my pain. My bank just now shows the amount as a pending credit to my account.
So, while we are out of pocket for the expenses related to the lawsuit, it will be withdrawn. As a reciprocal token of good faith and personal appreciation for the contribution Astromart makes to our community, a brown membership will be purchased in the next 15 minutes.

I look forward to making more interesting posts to this forum. It was highly instrumental and demonstrates that conscientious vendors are, indeed, paying attention.
